By accessing, viewing, or using the content, tools, data, or services available on or through getthebreakdown.com and engine.getthebreakdown.com (collectively, the “Site”), you indicate that you have read, understand, and agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site.
1. OWNERSHIP AND INTELLECTUAL PROPERTY
A. All materials contained on the Site are owned by The Breakdown LLC. All rights reserved.
B. All intellectual property rights are owned by The Breakdown LLC. This includes but is not limited to: the Transfer Portal Evaluation Engine, proprietary algorithms, scoring systems, statistical models, projection methodologies, conference translation systems, NIL valuation models, player comparison systems, design elements, logos, and branding unique to the Site.
C. The engine scores, projections, evaluations, NIL valuations, and comparable transfer analyses produced by the Site are proprietary outputs of The Breakdown LLC’s algorithms and constitute trade secrets protected under the Virginia Uniform Trade Secrets Act and the federal Defend Trade Secrets Act.
D. You may reference information from the Site under typical “fair use” standards, provided that The Breakdown is cited as the source (e.g., “per The Breakdown” or “via getthebreakdown.com”). Using information from the Site to support your own analysis or reporting is acceptable and encouraged, as long as attribution is provided.
E. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit any of the proprietary content of this Site, in whole or in part, without express written permission from The Breakdown LLC.
2. PROHIBITED USES
A. You may not use any automated means to access or use the Site. This includes scripts, bots, scrapers, data miners, browser automation tools, or similar software used to systematically extract, collect, download, or monitor data from the Site.
B. You may not systematically download, copy, record, or redistribute the Site’s evaluations, projections, scores, rankings, or other proprietary data, whether manually or through automated means.
C. You may not use data obtained from the Site to build, train, or operate a competing product or service.
D. You may not share, redistribute, or resell your account credentials or access to the Site’s subscription features with any third party.
E. You may not attempt to reverse-engineer, decompile, or otherwise discover the algorithms, source code, models, or methods underlying the Site’s evaluations and projections.
F. You may not frame, mirror, or replicate any portion of the Site on any other server or internet-based device without written permission.
This Site is protected from content theft by both passive and active monitoring. Any copyright infringement or misappropriation of proprietary content will be pursued according to applicable intellectual property law, the Digital Millennium Copyright Act (DMCA), and trade secret statutes.
3. DATA SOURCES AND DISCLAIMERS
A. The Breakdown uses publicly available college basketball statistical data as inputs to its proprietary evaluation engine. The raw statistical data (box scores, game results, player statistics) is factual information sourced from publicly accessible databases. The Breakdown’s proprietary value lies in its algorithms, models, feature engineering, conference translation methodology, and the evaluations and projections those systems produce — not in the underlying raw statistics. Statistical inputs are sourced primarily from CBBData (collegebasketballdata.com). Roster and biographical reference data is sourced in part from Wikipedia via the Wikimedia Enterprise API, available under the Creative Commons Attribution-ShareAlike 4.0 (CC BY-SA 4.0) license.
B. All evaluations, projections, scores, NIL valuations, and recommendations provided by the Site are estimates produced by statistical models. They are not guarantees of future performance. Actual player performance may differ materially from projections. The Breakdown LLC makes no warranty regarding the accuracy or reliability of any projection.
C. NIL Market Value estimates are projections based on player production metrics, conference strength, and market trends. They do not reflect actual NIL contracts, offers, or commitments. NIL valuations should not be used as the basis for financial decisions without independent verification. Contact the player or their representative for specific terms.
D. Transfer portal statuses displayed on the Site are compiled from public reporting (news sources, social media, official announcements). The Breakdown LLC makes no guarantee regarding the accuracy or timeliness of portal status information.
4. SUBSCRIPTION AND PAYMENT TERMS
A. Certain features of the Site may require a paid subscription. Subscription terms, pricing, and billing frequency will be clearly disclosed at the time of purchase.
B. Subscriptions are for individual use only. Institutional or multi-user access requires a separate licensing agreement.
C. Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings or by contacting [email protected]. Cancellation stops future renewals but does not retroactively refund the current billing period unless otherwise required by law.
D. Refund Policy: All subscription payments are non-refundable except as required by applicable law. If you experience a technical issue that materially prevents you from using the Site, contact [email protected] and The Breakdown LLC will work in good faith to resolve the issue, which may include a partial or full refund at The Breakdown LLC’s discretion.
E. Account Deletion and Subscriptions: You may request deletion of your account at any time as described in Section 6F. If you delete your account during an active subscription period, your access will end immediately and no prorated refund will be issued for the unused portion of the billing period unless otherwise required by law. Cancelling your subscription (which stops future billing but preserves your account) is generally preferable to account deletion if you may want to return.
F. Pricing Changes: The Breakdown LLC may change subscription pricing at any time. Existing subscribers will be notified of any price increase at least 30 days before it takes effect, and the new price will only apply to billing periods beginning after the notification period.
5. FAIR USE AND ATTRIBUTION
The Breakdown encourages coaches, analysts, and media to reference our evaluations and data in their work. To do so properly:
A. Cite The Breakdown as the source when referencing specific engine scores, projections, or evaluations (e.g., “The Breakdown projects Player X at 14.2 PPG in the Big 12” or “rated Strong by The Breakdown”).
B. Do not reproduce large volumes of data (e.g., full conference rankings, complete player databases, or bulk evaluation results) without written permission.
C. Screenshots of individual player evaluations for discussion purposes are acceptable with attribution. Bulk screenshots or systematic reproduction are not.
6. PRIVACY
A. The Site collects standard technical information including IP addresses, browser information, and access timestamps for the purposes of maintaining site performance, preventing abuse, and improving the service.
B. If you create an account, the Site stores the following information necessary to provide the service: your name, email address, and team affiliation. If you use the Watchlist feature, the players you save are stored so the Watchlist persists between sessions. If you use the Roster Builder feature, your saved rosters are stored so they persist between sessions. This account data — including your Watchlist contents and saved rosters — is private to your account and is never shared with, sold to, or disclosed to other users, coaches, agents, programs, advertisers, or third parties under any circumstances. The Breakdown LLC will not reference, summarize, or otherwise communicate any individual user’s Watchlist or roster activity externally, including in marketing materials, social media, or private conversations.
C. For logged-in users, the Site logs anonymous usage events to understand how the platform is being used. These events record which features are accessed (for example, that a search was performed or an evaluation page was opened), the timestamp of the action, and a session identifier that groups actions within a single browsing session. The Site’s analytics events do not record which specific players a user views, searches for, or interacts with — only that the action occurred. Player-specific information is stored only where it is necessary for a feature to function (such as the Watchlist), and is governed by the privacy commitments in Section 6B. Usage events are used solely for internal product analytics — to identify which features are most valuable, to measure user engagement, and to guide product improvements.
D. The Site does not sell, share, or disclose your personal information, account data, or usage data to advertisers, third parties, or other users. Aggregate, non-identifying usage statistics may be referenced in marketing materials (for example, “X% of users return weekly”), but no individual user’s activity, Watchlist, or roster data will ever be shared or referenced externally.
E. Payment information, if applicable, is processed by third-party payment processors and handled according to their respective privacy policies. The Breakdown LLC does not store full payment card numbers.
F. You may request deletion of your account and associated data at any time by contacting [email protected]. Account deletion removes your personal information, Watchlist, roster data, and usage event history.
G. The Site uses browser local storage and session storage to keep you logged in and to maintain session continuity. These are used solely for the operation of the Site and are not used for advertising or third-party tracking.
7. LIMITATION OF LIABILITY
A. The Site and its content are provided on an “as is” and “as available” basis. The Breakdown LLC makes no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, completeness, or fitness for a particular purpose of any information provided through the Site.
B. The Breakdown LLC shall not be liable to you or any third party for any consequential, incidental, indirect, punitive, or special damages (including damages relating to lost profits, lost data, or loss of goodwill) arising out of, relating to, or connected with the use of the Site, based on any cause of action, even if advised of the possibility of such damages.
C. You acknowledge that recruiting, NIL, and transfer decisions involve numerous factors beyond statistical analysis. The Breakdown’s evaluations are one input among many and should not be relied upon as the sole basis for any personnel, financial, or contractual decision.
8. GOVERNING LAW
You agree that by visiting and using this Site, you are governed by the laws of the Commonwealth of Virginia. Any and all actions or claims between you and The Breakdown LLC shall be brought in a court of competent jurisdiction within the Commonwealth of Virginia.
9. CHANGES TO TERMS
The Breakdown LLC reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
